R. v. T.D. – Domestic Assault

Allegations

T.D. was charged with multiple counts of assault following a serious domestic incident with an ex-spouse. The parties were in the midst of an ongoing separation at the time of the allegations. As a result of the serious nature of the charges, the Crown’s initial position was a jail sentence.

Defence Strategy

T.D. was a professional who could not afford a criminal record. Given the serious nature of the allegations, Mr. Fedorowicz moved early for T.D. to complete upfront counselling and compile comprehensive materials speaking to T.D.’s good character. In addition, recognizing that the criminal matter and a concurrent family court proceeding were closely connected, defence counsel also liaised directly with T.D.’s family law counsel to ensure the resolution reached in the criminal matter provided the strongest possible protection in the family proceeding.

Result

Despite the Crown’s initial position seeking a period of incarceration, Mr. Fedorowicz negotiated a resolution in which the Crown agreed to accept a plea to a lesser charge and agreed to a conditional discharge — meaning no conviction was ever entered. As a result, T.D. avoided a criminal record entirely.
