Allegations
Police attended a residence in response to a 911 call reporting a domestic incident between A.S. and their spouse. On scene, officers separated the parties and reviewed video captured on the complainant’s phone during the argument. Based on this review, A.S. was arrested for assault. They were released on an Undertaking with a number of conditions, including non-communication with their partner and a requirement that they stay away from the shared residence, subject to narrow exceptions.
Defence Strategy
Given the strain the charge and the accompanying release conditions were placing on A.S. and their young children, Mr. Fedorowicz prioritized a prompt and thorough review of the disclosure and arranged for A.S. to complete upfront counselling. Comprehensive information speaking to A.S.’s otherwise good character was compiled and presented to the Crown Attorney, together with submissions identifying weaknesses in the prosecution’s case.
Result
The Crown agreed to withdraw the assault charge. A.S. entered into a peace bond, resolving the matter without a criminal record and without further exposure to a trial.
